Strategic Counseling We assist our clients in development and implementation of a strategy to identify, evaluate and protect intellectual assets, including patents, copyrights, trademarks, confidential business information and trade secrets. Establishing a strategy that is aligned with business objectives is perhaps the single most important factor in controlling the significant costs involved in protecting intellectual property and ensures a consistency of decision-making protocols and a disciplined approach to managing these important assets. Elements of the strategy should include procedures to identify and document ideas, innovations, writings, brands, slogans, logos and other intellectual assets that are conceived or created by employees; procedures to review and evaluate those assets against the various forms of intellectual property protections available; and procedures to facilitate decisions regarding the protection of those assets that best fit the business goals and objectives. We have the skills and experience to assist clients in designing, developing and executing cost-effective strategies and tactics to identify and protect intellectual property assets, as well as strategies and tactics to ensure that the valid intellectual property rights of others are identified and respected. We have experience in conducting intellectual property audits; developing and administering processes for submission and evaluation of invention disclosures; selecting cost-effective filing strategies; conducting portfolio reviews; designing and conducting stage-gate intellectual property reviews and product clearance analysis; competitive patent analysis; and periodic monitoring and review of the relevant patent art. In addition, we assist clients in generating policies and procedures concerning protection of confidential business information and trade secrets, including appropriate use of employment agreements, non-compete covenants, company handbooks, exit interview procedures, facilities audits and other components of a comprehensive intellectual property protection program. Patents We provide a full range of patent legal services, including the acquisition, maintenance and enforcement of patent rights for various technologies in the United States and around the world. We have a depth of experience in the mechanical, electromechanical, chemical and electronic arts as well as physical science and material science technologies. Our services include the identification and evaluation of patentable subject matter; preparing, filing and prosecuting patent applications in the United States and abroad using a comprehensive network of patent firms around the globe. We can also provide assistance in searches on patentability and state of the art issues; preparing patentability analysis and opinions; conducting intellectual property due diligence reviews and audits; and monitoring competitive patent activities. We also have the knowledge and experience to provide analysis and opinions concerning patent validity, infringement, freedom to practice and product clearance reviews. Trademarks We assist our clients in the selection of appropriate marks by conducting trademark searches prior to final selection of a mark for filing, preparing and filing the application to register the mark, prosecute the application to allowance, defending the registration against any oppositions or cancellation proceedings that may be filed, and maintaining the registration through the renewal process and afterward. Our docketing practices ensure that all applications and registrations are properly logged for timely compliance with trademark laws and regulations. We can also assist our clients with trademark anti-counterfeiting and anti-piracy efforts, which, in addition to the registration of trademarks, services marks and domain names, would include implementation of product identification methods including hologram tags, utilizing advertising and promotional campaigns, monitoring trademark watching services and market surveillance operations, as well as registering with U.S. Customs and coordinating seizures. Transactional Matters Numerous business transactions will have implications for intellectual property assets. Apart from agreements directly involving the purchase, sale or licensing of intellectual asset, situations such as cooperative development projects, joint venture formation, contract research, and even consulting relationships all have implications regarding intellectual property rights. We assist our clients in drafting, reviewing and negotiating agreements for purchase, sale, transfer, or licensing of all forms of intellectual property rights, including assignments, licenses, service agreements, cooperative development agreements, material transfer agreements, confidentiality agreements, non-analysis agreements, consulting agreements, and other transactional documents involving intellectual property rights. In addition, we can assist clients in developing creative ways to capture value for their intellectual property in transactional contexts, including creative combinations of up-front fees, running royalties, balloon payments, and cross-licensing options. Trade Secrets and Restrictive Covenants Loss of confidential business information and trade secrets is a significant issue facing American business. Tessari Patent Law Group regularly draft, review and negotiate agreements concerning the protection of trade secrets and business information, including employment agreements, non-compete agreements, employee handbooks, exit interviews, non-solicitation agreements and similar documents. Litigation Support Tessari Patent Law Group recognizes that being a good trial lawyers requires a unique set of skills and talents. We do not believe we have the proper skills, nor the significant personnel resources necessary to act as litigation counsel for our clients. Nevertheless, personnel at the firm are familiar with litigation matters and we often provide litigation support to our clients and their trail counsel in intellectual property litigations.
